2. Acceptance of Terms
By accepting a quotation, placing an order, or using our services, you agree to be bound by these Terms of Service.
3. Services
We supply and/or install the following:

Gates
-
Bollards
-
Barriers
-
Turnstiles
All services are subject to availability, site conditions, and agreement in writing.
4. Quotations & Orders
4.1 All quotations are valid for 30 days unless otherwise stated.
4.2 Quotations are based on the information provided at the time and may be subject to change following a site survey.
4.3 A contract is formed once the quotation is accepted in writing or a deposit is received.
5. Pricing & Payment
5.1 Prices are inclusive/exclusive of VAT (as stated in the quotation).
5.2 A deposit may be required before work begins.
5.3 The remaining balance is due upon completion unless otherwise agreed.
5.4 We reserve the right to charge interest on overdue payments in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
6. Customer Responsibilities
You agree to:

Provide safe and clear access to the site

Ensure all necessary permissions, boundaries, and approvals are in place

Inform us of any underground services (e.g., water, gas, electric)

Remove obstacles prior to installation unless agreed otherwise
We are not liable for delays or damage caused by failure to meet these responsibilities.
7. Site Conditions
7.1 Our pricing assumes normal ground conditions.
7.2 Additional charges may apply for:

Hard ground, rock, or obstructions
-
Hidden underground utilities
-
Unexpected site issues
We will inform you before proceeding with additional work.
8. Installation
8.1 Installation dates are estimates and may be affected by weather, supply delays, or unforeseen circumstances.
8.2 We reserve the right to adjust installation methods if necessary.
8.3 Unless agreed, waste removal is/not included.
9. Product Variations
Products may vary slightly in colour, finish, or dimensions due to manufacturing tolerances. These variations do not constitute defects.
10. Cancellations & Refunds
10.1 Consumers may have the right to cancel within 14 days under the Consumer Contracts Regulations 2013.
10.2 This right may not apply to custom or made-to-measure products.
10.3 If work has begun within the cancellation period at your request, you may be charged for work completed.
11. Warranties
11.1 We provide a 12-month workmanship guarantee unless otherwise stated.
11.2 Manufacturer warranties apply to supplied products where applicable.
11.3 Warranties do not cover:

Misuse or accidental damage

Vandalism or theft

Normal wear and tear
12. Liability
12.1 We will not be liable for:

Indirect or consequential losses

Damage caused by undisclosed underground services

Delays outside our control
12.2 Nothing in these terms limits liability for death or personal injury caused by negligence.
13. Ownership of Goods
All goods remain the property of ClarkeWall Limited until paid in full.
14. Health & Safety
We comply with all relevant UK health and safety regulations. We reserve the right to suspend work if unsafe conditions are identified.
15. Delays & Force Majeure
We are not responsible for delays caused by events beyond our control, including but not limited to:

Severe weather
-
Supply chain disruption
-
Labour shortages
16. Termination
We reserve the right to suspend or terminate services if:

Payments are not made on time
-
These terms are breached
